Data processing addendum

This Data Processing Addendum ("DPA") forms part of the Terms of Service between the customer ("you") and Influence, a proprietorship ("Influence"), for Influence OS at os.influencepr.in.

Roles For account, billing, and security logs, Influence is the Data Fiduciary. For personal data you upload in Brand Memory, media lists, drafts, and connected-account identifiers that relate to people other than your own users, you are the Data Fiduciary and Influence is the Data Processor. You instruct Influence to process that data only to provide the product.

Instructions Influence will process customer personal data to host the workspace, run the agents you invoke, send transactional email you trigger, and publish approved LinkedIn text to an account you connect. Influence will not sell that data or use it to train public models.

Security Influence maintains access control on the production database, encryption in transit, encrypted storage of LinkedIn tokens, and staff access limited to what is required to operate the service. You are responsible for who you invite into the workspace.

Sub-processors Sub-processors are the hosting provider, the database provider, Cashfree, Resend when email is enabled, OpenAI when a model key is enabled, and LinkedIn when you connect it. Influence remains responsible for their processing to the extent the DPDP Act requires a processor to be responsible. You may object to a new sub-processor by ending the subscription before the change takes effect.

Assistance Influence will assist you with access, correction, and erasure requests that relate to data it processes for you, and with a personal-data breach notification, within a reasonable time after you write to the grievance contact in the privacy notice.

International transfers Where a sub-processor stores data outside India, the transfer is made to perform this contract.

Deletion On termination, customer content is deleted from the production database within 30 days, except invoices and records Influence must keep under tax law, and except backups that roll off within a further 30 days.

Audit Once in any twelve-month period, you may ask for a written description of the security measures in this DPA. Influence does not provide on-site audits of a shared host.

Order of precedence If this DPA conflicts with the Terms on a data-protection point, this DPA prevails. Otherwise the Terms prevail.
